Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and [ENTITY NAME, LLC], an Arizona limited liability company (“ArborSlate,” “we,” or “us”), governing your use of the ArborSlate service at arborslate.com (the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 18 years old to create an account. Children under 18 may use the Service only through a parent or guardian's account, with parental supervision.
ArborSlate provides homeschool families with tools to keep academic records, track state compliance, manage scholarship and ESA expenses, generate transcripts and report cards, and (where enabled) interact with an AI tutor. We may add, modify, or remove features over time.
Some features are included in all plans; others are limited to specific subscription tiers. The current feature breakdown is described on our Pricing page.

We may suspend or close accounts that we reasonably believe are being used for fraud, abuse, or violation of these Terms.
New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial, you may subscribe to a paid plan or your account will move to a read-only state with continued export access.
Paid plans renew automatically on a monthly or annual basis depending on the plan you choose. By subscribing, you authorize us to charge your payment method on the renewal date.
Prices are listed in U.S. dollars. We process payments through Stripe; their consumer terms apply to the payment relationship.
You can cancel any time through the billing portal in your account settings. Cancellation takes effect at the end of your current billing period. You retain access through that period and you keep your data.
We offer pro-rated refunds for the unused portion of an annual subscription if you cancel within 30 days of renewal. Monthly subscriptions are non-refundable for the current period but cancel at period end. One-time transcript purchases ($19) are refundable within 7 days of purchase if you have not downloaded the transcript.
We may change subscription prices. We'll notify you by email at least 30 days before any price change affects your account. If you don't agree to the new price, you can cancel before the change takes effect.
If a payment fails, we'll retry over several days and notify you by email. If the payment isn't resolved, your account will move to a read-only state with continued export access for 90 days, then close.

We may suspend or close accounts that violate these rules.
Everything you upload, enter, or create in the Service — grades, attendance, reading logs, portfolio uploads, transcripts, ESA records, AI tutor conversations, and so on — is your content. You retain all rights to it.
You grant us a limited license to store, process, transmit, and display your content for the sole purpose of providing the Service to you. We do not use your content for any other purpose, and specifically we do not use it to train AI models.
You can export, edit, or delete your content at any time. We cannot recover deleted content after 90 days.
You are responsible for the legality and accuracy of the content you enter. Specifically, if you enter information about other people (including your children), you represent that you have the right to do so.
The AI tutor feature is offered as a supplement to your child's homeschool education, not as a substitute for parental instruction or judgment.
We provide state compliance information (required subjects, instruction-day minimums, deadline tracking, template documents) for reference only. We are not lawyers and we are not providing legal advice.
State homeschool laws change. We work to keep our state information current, and we display the last-reviewed date on each state, but we make no warranty that the information is accurate or up to date.
You are solely responsible for understanding and complying with your state's homeschool laws. Before relying on any state-specific feature, confirm the requirements with your state's Department of Education or with an attorney familiar with homeschool law in your state.
We provide tools to track ESA (Empowerment Scholarship Account) and similar scholarship expenses. We are not your ESA program administrator. ArborSlate is not affiliated with the Arizona Department of Education, ClassWallet, Step Up For Students, or any other ESA platform.
You are solely responsible for complying with your state's ESA rules, submitting documentation to the correct authorities, and ensuring expenses qualify under your program. Our categorization, disallowed-vendor warnings, and audit-defense exports are tools to support your record-keeping — not a guarantee that any specific expense will be approved.
We do not provide tax advice. Consult a tax professional regarding the tax treatment of ESA funds in your situation.
The Service, including its design, code, copy, logos, and brand, is the property of ArborSlate and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal homeschool record-keeping purposes during your subscription.
You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.
We work to keep the Service available 24/7, but we do not guarantee uninterrupted operation. We may need to perform maintenance, respond to outages, or make changes that temporarily affect availability.
We are not liable for any downtime, data loss, or other harm resulting from service interruption, except as required by law.
You can cancel your account at any time. We can suspend or close your account if you violate these Terms, if your payment fails and is not resolved, or if we discontinue the Service.
On account closure (by you or by us):
The service is provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We do not warrant the accuracy of state compliance information, ESA categorization, AI tutor responses, transcript generation, or any other output of the Service.
Some jurisdictions don't allow exclusion of certain warranties, so portions of this section may not apply to you.
To the maximum extent permitted by law, ArborSlate's total liability for any claim arising from or related to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100.
In no event shall ArborSlate be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Some jurisdictions don't allow limitation of certain damages, so portions of this section may not apply to you.
You agree to indemnify and hold harmless ArborSlate, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles.
Any dispute arising out of these Terms or the Service shall be resolved in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction in those courts.
Class action waiver: you agree that any dispute shall be brought individually and not as a class action, collective action, or representative action, to the extent permitted by law.
We may update these Terms from time to time. If we make material changes, we'll notify you by email and post the updated Terms on this page with a new “last updated” date. Continued use of the Service after a change constitutes acceptance.
If you don't agree to a change, you may cancel your account before the new Terms take effect.
